Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Secret Jingle mobile application and related services (collectively, the "Service"), operated by Secret Jingle ("we", "us", or "our"). Please read them carefully.

1. Acceptance of these terms

By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to create an account and use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service you represent that you meet these requirements.

3. Your account

You may sign in using a supported third-party identity provider (for example Apple, Google, or Discord). You are responsible for maintaining the security of the account you sign in with and for all activity that occurs under your Secret Jingle account. Notify us promptly of any unauthorized use.

4. How the game works

Secret Jingle is a group game in which players write prompts, generate songs performed by cartoon avatars, and deliver them anonymously to other players who then attempt to guess the sender. Group administrators may set themes and deadlines. If you miss a submission deadline and the following grace period, you may be skipped or removed from a game round. These mechanics are part of normal gameplay.

5. User content and moderation

You retain ownership of the prompts, lyrics, images, and other content you create ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display that content solely to operate and provide the Service to you and the other members of your group.

You are solely responsible for your User Content. We may review, remove, or restrict content that we reasonably believe violates these Terms, and may suspend or terminate accounts that do so repeatedly. We do not guarantee that any particular content will be reviewed or retained.

6. Prohibited conduct

You agree not to:

• Upload photos of, or create avatars depicting, any person without their consent;
• Create content that is unlawful, harassing, hateful, defamatory, sexually explicit, or that targets a person for abuse;
• Impersonate any person or misrepresent your affiliation;
• Infringe the intellectual property, privacy, or other rights of others;
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service;
• Use the Service for any commercial purpose not expressly permitted by us; or
• Use the Service in violation of any applicable law or regulation.

7. Intellectual property

The Service, including its software, models, artwork, avatars, branding, and design, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in and to the Service.

8. Third-party services

The Service integrates third-party services (for example identity providers and push-notification providers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

9. Termination

You may stop using the Service and delete your account at any time from within the app or by contacting us. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue the Service. Upon termination, the rights granted to you under these Terms will end.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure. Generated songs, lyrics, and avatars are produced automatically and may be inaccurate or unexpected.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Secret Jingle is established, without regard to its conflict-of-laws principles. [REVIEW: specify governing law and venue before launch.]
